SOCIAL MEDIA TERMS OF USE
By responding #YesCaliforniaClosets you agree to the following Social Media Terms of Use:
You hereby grant California Closet Company, Inc. and its franchisees, affiliates, assigns, and licensees (individually and collectively, “California Closets”) a non-exclusive, perpetual, royalty-free, irrevocable, transferrable, sublicensable (through multiple tiers) right and worldwide license to use, reproduce, publish, translate, create derivative works from, distribute, perform publicly, and publicly display for all or any purposes whatsoever, your comment(s) and photographs posted to social media platforms, whether now known or later developed (e.g., Facebook, Instagram, Pinterest, TikTok, Youtube, Twitter) (collectively, “Social Media Platforms”) tagged with the hashtag #CaliforniaClosets or similar hashtags referencing California Closets in an identifiable manner, or in relation to which you have responded #YesCaliforniaClosets (your “User Content”), in any form, media, or technology now known or hereafter developed, including but not limited to the Internet (such as social media channels, blogs, California Closets-related websites), mobile applications, gaming platforms, and press releases. You also hereby grant California Closets the right to use your name and likeness solely as necessary to exercise the foregoing license rights.
You acknowledge and agree that California Closets’ use of your User Content is entirely at California Closets’ discretion and California Closets may cease use of it at any time.
You hereby represent and warrant that: (i) you exclusively own all right, title and interest in and to your User Content and have all necessary rights and authority to grant California Closets the license granted herein; (ii) your User Content does not infringe, misappropriate, or violate any third party’s intellectual property rights or rights of publicity or privacy, or violate any applicable law or regulation; and (iii) California Closets’ use of your User Content will not infringe any third party’s intellectual property rights, or rights of publicity or privacy, or violate any applicable law or regulation.
You hereby release, discharge, and agree to indemnify and hold harmless California Closets and its officers, directors, and employees, from all actions, claims, damages, liabilities, costs and expenses arising out of California Closets’ use of your User Content.
By permitting California Closets to use your User Content, you consent to California Closets processing any personal data contained within it as well as your social media handle. You can withdraw this consent at any time by contacting California Closets via direct message at @calclosets on the following Social Media Platforms: Instagram or Facebook. Please visit the Privacy Policy to understand more about how California Closets will process your personal information.
If you delete your #YesCaliforniaClosets approval post or your User Content from any Social Media Platform, your agreement to these Social Media Terms of Use is still binding.
These Social Media Terms of Use will be governed and interpreted pursuant to the laws of the State of California, notwithstanding any conflicts of law. You specifically consent to personal jurisdiction in California in connection with any dispute between you and California Closets.
